激励与协调:开放政府的治理机制研究——以“Peer to Patent”项目为例Incentives and Coordination:Research on Governance Mechanismsfor Open Government——A Case Study Based on "Peer to Patent" Project

摘要(Abstract):
通过数据开放提升合作治理能力,以最终建立"透明、参与、协同和负责"的"开放政府",已成为当前共识。但问题在于,"开放数据"并不自然带来"开放政府"的形成,后者还需克服多元主体参与治理的激励和多元主体集体行动的协调两大问题。具体而言,激励问题的核心是劳动分工、收益匹配与投机约束的机制创新;协调问题则重在决策评估和问责制度的规则重塑。本文将以美国联邦政府"Peerto Patent"项目为例,梳理并总结该案例在解决这两个问题上的机制创新。以此为基础,本文进一步从实践层面的可能性和价值层面的合法性两方面对该项目治理机制的可推广性问题进行了深入讨论。
